Driving Under the Influence (DUI) Explained

In California, people can be accused of and arrested for driving under the influence if they do one of two things, or both.  First, people can be arrested if they drive a motor vehicle while under the influence of drugs and/or alcohol.  This especially holds true for people who are below the legal drinking age of 21 as underage offenders can be charged with drunk driving if they consume any amount of alcohol and drive.  Second, people can be arrested for DUI if they have a blood alcohol concentration (BAC) of 0.08% or higher.  In the state of California, the legal BAC is 0.08%, which means that if people are driving with blood alcohol limits that are much higher than this percentage, they may be subjected to enhanced charges if they are caught by police.

Once people have been pulled over by police for suspicion of drunk driving, police will ask them to consent to a breath alcohol test and also field sobriety tests.  The breath test will inform police of peoples’ blood alcohol concentration whereas field sobriety tests will give police an idea of how impaired drivers are.  It is believed that if people fail the field sobriety tests, it is because the alcohol they have consumed is affecting their coordination.
