Scheduling a California DMV Hearing

After people have been arrested for driving under the influence (DUI) in the state of California, police officers will serve them with a pink notice of suspension.  From the time this notice is issued, people will only have 10 days to schedule a hearing with the California Department of Motor Vehicles.  If people do not schedule their hearings, their driver’s licenses will automatically be suspended.  This means that they will no longer be allowed to drive for a set period of time.

The DMV Hearing Process

People who have scheduled their hearings within the allotted timeframe must appear at their local DMV on the date of their hearings.  They will then go into a room where a DMV administrator will preside over the hearing.  Many people are under the assumption that they must prove they are not guilty of DUI to keep their driver’s licenses.  They think that they must justify why they should be able to keep their driving privileges.  However, the hearing is really meant for the DMV to justify, beyond all doubt, that peoples’ driver’s licenses should be suspended.  For this very reason, the DMV administrator serves as both a prosecutor and a judge throughout the entire hearing.

During the hearing, the administrator will present evidence as to why a person’s license should be suspended.  If the administrator has sufficient evidence (such as a valid breath alcohol test result of 0.08% or higher), he or she may rule that the person is “guilty”.  For first time offenders, this may lead to a suspension of 4 months or more.  However, if evidence is lacking, the administrator may rule that the person is “not guilty”.  The person’s driving privileges would then be reinstated.
